Licence agreement
1.Purpose
Jabeur Digital Solutions grants the client centre a personal, non-exclusive and non-transferable right to use the Classimum software, for the duration of the subscription taken out and for its own needs only.
2.Ownership
The software, its source code, its interface, its documentation and its updates remain the exclusive property of Jabeur Digital Solutions. The subscription involves no transfer of intellectual property. In particular, reproduction, redistribution, resale, rental, making available to third parties and reverse engineering are prohibited, unless the publisher has given its prior written consent.
3.Your data belongs to you
The data entered by the centre, student records, groups, payments, staff, remains its full and entire property. The publisher processes it as a processor, on the centre's instructions, for the sole purpose of providing the service. The centre can export its data at any time from its space, in spreadsheet format.
4.Confidentiality and security
Each centre is isolated from the others at the level of the database itself. The publisher refrains from any access to a centre's data outside support operations expressly requested, technical maintenance and backup. An encrypted weekly backup of the database is being set up; the publisher does not guarantee a daily backup. The centre can export its data from its space at any time (article 3).
5.Availability
The publisher uses reasonable means to ensure the continuity of the service. Scheduled interruptions are announced in advance. No quantified availability guarantee is given outside a specific service agreement.
6.Term, price and termination
The subscription is taken out monthly or yearly, renews automatically, and can be cancelled at any time from the centre's space, without notice or penalty. Cancellation takes effect at the end of the current period; sums already paid remain with the publisher. Prices may change, with no effect on a period already paid, and subject to one month's notice.
7.What happens to the data at the end
On termination, the centre's data is kept for three months, in case of a return, then deleted. The centre may request its immediate deletion, or its delivery in spreadsheet format, by simple written request from our contact page.
8.Governing law
This licence is governed by Tunisian law. The parties will endeavour to settle any dispute amicably before any legal action.
